Fubara: Rivers CJ declines to constitute impeachment panel, cites court orders

The Chief Judge of Rivers State, Justice Simeon Amadi, has formally declined a request from the State House of Assembly to constitute a panel to investigate Governor Siminalayi Fubara and his deputy, Prof. Ngozi Odu.

In a letter to the Assembly Speaker, Rt. Hon. Martin Amaewhule, Justice Amadi cited two interim injunctions from the State High Court. These orders, secured by the governor and deputy governor, restrain him from receiving or acting on any request from the Assembly regarding an impeachment investigation panel.

The Assembly had invoked constitutional procedures on January 16, requesting the panel over allegations of gross misconduct.

Justice Amadi confirmed he received both the Assembly’s request and the court orders.

He stated that the legal principle of lis pendens requires all parties to await the outcome of ongoing appeals filed by the lawmakers against the injunctions. He emphasized that compliance with subsisting court orders is paramount.

“My hand is fettered,” the Chief Judge wrote, noting he is “legally disabled at this point” from performing his constitutional duty under Section 188(5) until the legal process is concluded.

He urged all parties to respect the rule of law.
